Overview

Welcome to Nutrascience. These Terms of Service (“Terms”) are a binding agreement between you (“you”) and Nutrascience (“we”, “us”, “our”). They govern your use of our website, online store, and all related products, services, content, and tools (collectively, the “Services”).

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility & Account

You represent that you are at least the age of majority in your jurisdiction of residence, and that any registration information you provide is current, accurate, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer your account to anyone else.

2. Products & Information

We work hard to represent our products accurately. However, product images and descriptions may differ slightly on your screen due to device settings. Product availability, formulations, and packaging are subject to change without notice.

No medical advice. Content provided on our site is for informational purposes only. Our products are not intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified health professional before starting any new supplement.

3. Orders & Acceptance

When you place an order, you are making an offer to purchase. An agreement is formed only when we accept your order and send a confirmation email. We reserve the right to refuse or cancel any order at any time, for any reason, including after confirmation, and will attempt to notify you using the contact details provided. If we cancel a confirmed order, we will promptly issue a full refund.

All purchases are subject to our Return & Quality Guarantee. Products are sold for personal, non‑commercial use only. We do not authorise resale.

4. Prices, Payments & Billing

All prices are displayed in Malaysian Ringgit (MYR) unless otherwise indicated at checkout. Prices are inclusive of applicable Malaysian taxes unless otherwise stated. Additional shipping charges and any customs duties or import taxes for orders outside Malaysia are your responsibility and will be shown at checkout where applicable.

We reserve the right to change prices at any time. The price charged is the one in effect at the time your order is placed, as shown in your order confirmation.

You agree to provide accurate billing and payment information. We may offer promotions from time to time; separate terms may apply and will govern in the event of any conflict.

5. Shipping, Title & Risk

Delivery and shipment dates are estimates only. We are not liable for delays caused by carriers, customs, or events beyond our reasonable control. However, we may, at our discretion, offer replacements for transit damage as described in our Return & Quality Guarantee. Once handed to the courier, delivery is managed by third-party logistics partners. If an issue occurs, contact us and we’ll work with the courier to help resolve it fairly.

Please inspect your order upon receipt and report any damage or defects within the timeframes set out in our Return & Quality Guarantee.

6. Intellectual Property

The Services and all content (including text, images, graphics, logos, trade marks, videos, and software) are owned by Nutrascience or its licensors and are protected by Malaysian and international copyright, trade mark, and intellectual property laws.

You may use the Services for personal, non‑commercial purposes only. You must not reproduce, modify, distribute, or exploit any content without our prior written consent. All rights not expressly granted are reserved.

7. Third‑Party Tools & Links

Our Services may include tools or links to external websites provided by third parties. We do not endorse or control these third‑party resources, and you use them at your own risk. Review the applicable third‑party terms and privacy policies.

We are not liable for any loss or damage arising from your use of third‑party tools, websites, or services.

8. Shopify

Our store is powered by Shopify, which provides the e‑commerce platform that enables us to offer the Services. Any purchase you make is directly with Nutrascience, not with Shopify. You agree that Shopify is not responsible for any aspect of our products, services, or transactions.

Shopify may collect and process certain personal data independently; this is described in our Privacy Policy and Shopify’s own Privacy Policy.

9. User Content & Feedback

If you submit reviews, comments, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty‑free licence to use, reproduce, modify, display, and publish that Feedback for any purpose, including commercial use, and in any medium. This licence specifically includes the right to use your name or username alongside your Feedback in marketing materials, without further notice or compensation.

You represent that your Feedback does not violate any third‑party rights and is not unlawful, offensive, or false. We have no obligation to maintain Feedback in confidence or to compensate you for it. We reserve the right to remove any Feedback at our discretion.

10. Prohibited Activities

You agree not to misuse the Services. Prohibited acts include, but are not limited to:

• Using the Services for any unlawful or fraudulent purpose.

• Uploading viruses or malicious code.

• Interfering with security features, circumventing access controls, or scraping data.

• Impersonating others or transmitting spam.

• Using automated tools (including AI agents) in violation of our robots.txt or without identification.

• Attempting to resell our products without authorisation.

We may suspend or terminate access immediately for any violation.

11. Errors & Omissions

Occasionally, information on our site may contain typographical errors or inaccuracies related to product descriptions, pricing, or availability. We reserve the right to correct any errors and to cancel orders affected by such inaccuracies, including after confirmation.

12. Disclaimers & Limitation of Liability

To the fullest extent permitted by law:

• The Services and all products are provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.

• We do not guarantee that the Services will be uninterrupted, error‑free, or completely secure.

Nothing in these Terms excludes or restricts any statutory right or remedy you may have under the Consumer Protection Act 1999 (Malaysia) or any other mandatory consumer law that cannot be waived or limited by contract. To the extent such laws apply, our liability is limited to the maximum extent permitted.

In no event will Nutrascience, its officers, employees, affiliates, or service providers (including Shopify) be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunity, arising from your use of the Services or products, even if advised of the possibility.

13. Indemnification

You agree to indemnify and hold harmless Nutrascience, its affiliates, and their respective directors, employees, and agents from any claims, losses, or damages (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your misuse of the Services.

14. Termination

We may terminate or suspend your access to the Services at any time, without notice, for any reason, including suspected breach of these Terms. Provisions that by their nature should survive termination will continue to apply.

15. General Provisions

• Governing Law & Jurisdiction: These Terms are governed by the laws of Malaysia. Any dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia.

• Severability: If any provision is held invalid, the remaining provisions will continue in full force.

• Waiver: Our failure to enforce any right does not waive it.

• Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms without notice.

• Entire Agreement: These Terms, together with our Privacy Policy and Return & Quality Guarantee, form the entire agreement between you and us regarding the Services.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes as required by applicable law, and the updated version will be posted on this page. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
